1.4
These Terms, together with the membership inclusions, pricing and payment details disclosed at checkout, form your membership agreement.

You should read these Terms before joining. We will make them available before purchase and provide access to them after registration.
1.6
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Membership services and inclusions

2.1
Forward Moves provides a digital membership intended to support fitness professionals, health and wellness coaches and business owners through business education, resources and professional development tools.
2.2
Depending on your selected membership, inclusions may include:
  • Business and coaching resources.
  • Educational materials, templates and checklists.
  • Digital resources and downloadable assets.
  • Business systems and supporting tools.
  • Training and professional development content.
  • Nutrition-related resources and sample eating guidelines.
  • Access to an online membership portal.
  • Other membership benefits expressly advertised at the time of purchase.
2.3
The specific services and resources included in your membership will be disclosed before purchase.
2.4
Unless expressly advertised, membership resources are not individually customised to your business or personal circumstances.
2.5
Forward Moves will take reasonable care to deliver the core membership services and inclusions as advertised.
2.6
We may make reasonable updates or improvements to resources, educational materials and membership features. Where a proposed change materially reduces core membership benefits, we will provide advance notice and an appropriate option or remedy, including the right to cancel without liability for future services where appropriate or legally required.
2.7
We do not guarantee particular business, financial or professional outcomes from membership participation.
3

Four-month minimum commitment

3.1
The Forward Moves Membership has an initial minimum commitment of four (4) calendar months.
3.2
The calendar month in which you join counts as month one of your four-month commitment, even where you join partway through that month.
3.3
Where you join partway through a calendar month, your four-month commitment comprises:
  • Month 1: The initial pro-rata membership period.
  • Month 2: The following full calendar month.
  • Month 3: The next full calendar month.
  • Month 4: The final full calendar month of your initial commitment.
3.4
Where you join on the first day of a calendar month, the commitment comprises four full calendar months.
3.5
By purchasing a membership, you agree to pay the applicable fees for your initial four-month commitment, subject to any cancellation or other rights available under law.
3.6
Your initial commitment, payment dates, pro-rata amount (if applicable) and minimum financial commitment will be disclosed before payment.
3.7
Once the initial four-month commitment has ended, your membership automatically continues on a month-to-month basis.
3.8
There is no further minimum commitment or lock-in period following the initial four months.
3.9
Automatic continuation does not create another four-month commitment.
4

Pro-rata membership payments

4.1
Where a Member joins partway through a calendar month, Forward Moves will charge a pro-rata membership fee for the remaining days of that calendar month.
4.2
The pro-rata amount will be calculated by dividing the applicable monthly membership fee by the total number of calendar days in that month and multiplying it by the number of membership days remaining in that month, including the joining date.
4.3
The pro-rata amount will be displayed to the Member before payment is completed.
4.4
Payment of the pro-rata amount provides membership access from the agreed commencement date until the end of that calendar month.
4.5
The initial pro-rata period counts as the first month of the four-month minimum commitment.
4.6
Members will not be required to pay an additional four full months after the initial pro-rata period.
4.7
The first full monthly payment following a pro-rata registration will be processed on the first day of the following calendar month.
4.8
All subsequent full monthly membership payments will be processed on the first day of each calendar month until the membership is cancelled or otherwise ends.
5

Membership fees and automatic payments

5.1
Membership fees are quoted in Australian Dollars (AUD) and include GST where applicable unless expressly stated otherwise.
5.2
The monthly membership fee, billing arrangements and any mandatory additional charges will be disclosed before registration.
5.3
Monthly membership payments are due on the first (1st) day of each calendar month.
5.4
By subscribing, you authorise Forward Moves and its nominated payment provider to process the agreed recurring membership payments using your nominated payment method.
5.5
Your payment authorisation continues until your membership ends in accordance with these Terms, subject to applicable law.
5.6
Members are responsible for providing accurate payment information and updating expired or invalid payment details.
5.7
Where a payment is unsuccessful, we may notify you and reasonably attempt to process the outstanding amount again in accordance with your payment authorisation.
5.8
Where payment remains outstanding, Forward Moves may suspend access after providing reasonable notice and an opportunity to resolve the issue.
5.9
A failed payment does not itself constitute cancellation of your membership.
5.10
Any validly incurred outstanding fees remain payable, subject to applicable legal rights, remedies and dispute processes.
5.11
Forward Moves will not impose undisclosed penalties or arbitrary administrative charges for failed payments.
5.12
Where legally recoverable amounts remain outstanding, Forward Moves may use appropriate debt recovery processes in accordance with applicable law. We will not seek amounts that are not legally owed.
6

Automatic month-to-month continuation

6.1
Following completion of your initial four-month minimum commitment, your membership automatically continues on a month-to-month basis.
6.2
Your membership continues at the applicable monthly rate, with payments processed on the first day of each calendar month.
6.3
The ongoing month-to-month membership has no additional lock-in period.
6.4
After the initial commitment, you may cancel at any time in accordance with Section 7.
6.5
We will clearly disclose the automatic continuation arrangement before your initial purchase.
6.6
Forward Moves will provide a reminder before the end of the initial commitment period, identifying the upcoming transition to month-to-month membership and explaining how to cancel.
6.7
Automatic continuation will not result in a new fixed-term commitment unless a different arrangement is separately and expressly agreed.
7

Membership cancellation

7.1
Members may request cancellation at any time, including during the initial four-month commitment.
7.2
To cancel, Members may email info@forwardmoves.com.au or use an available cancellation function within the membership platform.
7.3
Members may give advance notice during the initial four-month period requesting that their membership end at the conclusion of that commitment.
7.4
Where a Member cancels for convenience during the initial four-month commitment, the agreed fees for the remaining portion of that minimum commitment generally remain payable.
7.5
Clause 7.4 does not apply where the Member has a legal right to end the agreement without those charges, including where an applicable consumer guarantee has not been met, where misleading conduct gives rise to a cancellation remedy, or where another applicable legal right permits cancellation.
7.6
Where cancellation is requested during the initial commitment, Forward Moves will explain the remaining payment obligations and confirm the membership end date.
7.7
Following completion of the initial four-month commitment, Members may cancel at any time without an additional cancellation fee.
7.8
To prevent the next monthly renewal, a cancellation request must be received before the next scheduled payment on the first day of the following month.
7.9
Where notice is received before the next billing date, no payment for the following billing period will be collected, provided the minimum commitment has been completed or a legal right to earlier cancellation applies.
7.10
Where a Member cancels after their monthly payment has been processed, cancellation ordinarily takes effect at the end of that paid calendar month. Any statutory rights to an earlier cancellation or remedy remain unaffected.
7.11
Cancellation requests will be acknowledged in writing within a reasonable timeframe, ordinarily within two business days.
7.12
A cancellation request received through an authorised cancellation channel is effective from the date of receipt for determining whether the next payment is due. Internal processing delays will not create an additional renewal charge.
7.13
We will not require Members to attend a telephone call, provide an explanation or participate in a retention process as a condition of cancelling.
7.14
Members will ordinarily retain access until their effective membership end date, provided applicable payments have been made and their access has not otherwise been lawfully suspended or terminated.
8

Refunds and consumer guarantees

8.1
Forward Moves complies with the Australian Consumer Law to the extent it applies to the membership and the Member.
8.2
Consumer guarantees may apply to our services, including requirements that applicable services be provided with due care and skill, be fit for a disclosed purpose where relevant, and be supplied within a reasonable time where no timeframe has been agreed.
8.3
Where an applicable consumer guarantee is not met, Members may be entitled to a remedy depending on the circumstances, including rectification, cancellation, a refund or compensation.
8.4
Forward Moves does not generally offer refunds solely because a Member changes their mind, decides not to use the service or no longer wishes to continue, where the membership has otherwise been supplied as agreed and no legal right to a remedy applies.
8.5
The change-of-mind policy in clause 8.4 does not restrict any rights under Australian Consumer Law.
8.6
Where Forward Moves is unable to provide paid-for membership services, or where a material failure occurs, we will assess and provide the applicable remedy required by law.
8.7
Refund or remedy requests may be submitted to info@forwardmoves.com.au.
8.8
Refund requests will be assessed fairly, with reference to the circumstances, our obligations and applicable legal requirements.
8.9
Members will not be required to waive statutory rights as a condition of receiving a remedy to which they are legally entitled.
9

Pricing changes

9.1
Forward Moves may review membership prices from time to time.
9.2
The agreed membership fee will not be increased during the initial four-month commitment without the Member's express agreement.
9.3
For Members continuing month-to-month, we will provide at least thirty (30) days' written notice of a proposed price increase.
9.4
The notice will identify the revised fee and the date the change is proposed to take effect.
9.5
Members may cancel before the increased fee takes effect without any additional cancellation charge, once the initial commitment has ended.
9.6
Where an increase would otherwise take effect before the initial commitment ends, the existing agreed price will continue until that commitment has concluded unless the Member expressly agrees otherwise.
9.7
No price increase will be applied retrospectively to payments already processed.
10

Changes to membership content and services

10.1
Forward Moves may make reasonable changes to its membership content, resources, online platform and delivery methods.
10.2
Such changes may include updating educational content, replacing outdated resources, improving systems or modifying the delivery of particular benefits.
10.3
We will not materially reduce the core services or inclusions promised at purchase without providing reasonable advance notice and an appropriate option or remedy.
10.4
Where a material change adversely affects a Member's agreed core benefits, we will offer an appropriate alternative or a right to end the agreement without liability for affected future services, subject to applicable law.
10.5
Nothing in this section allows Forward Moves to avoid responsibility for services it has contracted to provide.
11

Intellectual property and membership resources

11.1
All membership resources, educational content, templates, business tools, videos, graphics, written materials and other original content remain the intellectual property of Forward Moves or the applicable rights holder.
11.2
Purchasing a membership does not transfer ownership of that intellectual property.
11.3
Members receive a limited, non-exclusive and non-transferable licence to access and use membership resources for their own business purposes, subject to the permitted uses communicated with those resources.
11.4
Where resources are expressly intended for use with a Member's own clients, Members may use those resources for that purpose in accordance with the applicable licence.
11.5
Unless expressly authorised, Members must not:
  • Resell Forward Moves resources as standalone products.
  • Share their login credentials with other individuals or businesses.
  • Redistribute restricted resources to other coaches or industry peers.
  • Upload proprietary resources to publicly accessible libraries.
  • Reproduce Forward Moves' educational content for commercial redistribution.
  • Present Forward Moves' original materials as their own intellectual property.
  • Use restricted membership resources to operate a competing subscription or resource library.
11.6
Members may not use Forward Moves trademarks, logos or other protected brand elements without appropriate permission.
11.7
Forward Moves may investigate suspected misuse and take proportionate, lawful action to protect its intellectual property.
11.8
The licence for accessing the membership portal and restricted resources ends when the membership ends. Any permission to continue using previously downloaded materials will be determined by the applicable resource licence disclosed when those materials were provided.
11.9
Nothing in these Terms removes any intellectual property rights or permitted uses that a Member is entitled to retain under law.
12

Nutrition and educational disclaimer

12.1
Certain Forward Moves resources may include general nutrition education, sample daily eating guidelines, meal examples and health-related educational information.
12.2
Unless expressly stated otherwise, these resources are not individually prescribed meal plans, medical advice or personalised dietetic services.
12.3
Nutrition-related examples are intended for general educational purposes and may not be appropriate for every individual.
12.4
Members using resources within their own coaching businesses are responsible for working within their qualifications, professional scope of practice and applicable legal requirements.
12.5
Members should not represent general nutrition examples as personally prescribed dietary advice without an appropriate individual assessment by a suitably qualified professional.
12.6
Forward Moves does not guarantee specific health, nutrition or fitness outcomes from the use of these resources.
12.7
Nothing in this section excludes any legal obligation or liability that cannot lawfully be excluded.
13

Member responsibilities

13.1
Members agree to:
  • Provide accurate registration and payment details.
  • Keep membership account credentials secure.
  • Use the membership platform lawfully.
  • Respect intellectual property and confidentiality obligations.
  • Follow reasonable platform and community conduct requirements.
  • Treat staff, service providers and other Members respectfully.
13.2
Members are responsible for their own business decisions and how they implement educational resources, subject to Forward Moves' legal responsibilities for the quality and accuracy of the services it provides.
13.3
Where specialist legal, financial, medical or other regulated advice is required, Members should seek advice from a suitably qualified professional.
14

Account suspension and termination

14.1
Forward Moves may suspend or terminate membership access where there is a material breach of these Terms, serious unlawful conduct, substantial misuse of intellectual property or an unresolved payment default.
14.2
Except where immediate action is reasonably necessary to prevent serious harm, fraud or unlawful conduct, Forward Moves will provide written notice explaining the concern and a reasonable opportunity to remedy the breach.
14.3
Any suspension or termination will be proportionate to the circumstances and consistent with applicable law.
14.4
Where Forward Moves terminates a membership without Member fault or another lawful justification, it will provide an appropriate refund or other remedy for any prepaid services not supplied, as required by law.
14.5
Termination does not extinguish validly incurred payment obligations or continuing intellectual property protections, subject to applicable law.
15

Third-party platforms

15.1
Forward Moves may use third-party software, payment processors, communication systems and hosting services to deliver its membership.
15.2
Temporary service interruptions may occur as a result of maintenance, platform updates or technical issues.
15.3
Forward Moves will take reasonable steps to address interruptions affecting the services it has agreed to provide.
15.4
Where disruptions materially affect paid-for services, Members may be entitled to an appropriate remedy under applicable law.
15.5
Forward Moves will not use third-party service arrangements to avoid its own statutory responsibilities.
16

Privacy and confidentiality

16.1
Forward Moves will handle personal information in accordance with its Privacy Policy and applicable privacy laws.
16.2
Members must not unlawfully disclose confidential business information, restricted membership material or information about other Members obtained through the services.
16.3
Confidentiality obligations do not prevent Members from obtaining professional advice, reporting concerns to regulators, exercising legal rights or making disclosures required by law.
16.4
Confidentiality obligations continue after membership termination where the information remains confidential and protection is legally appropriate.
17

Variations to these terms

17.1
Forward Moves may update these Terms where reasonably necessary to reflect legislative changes, service improvements or operational requirements.
17.2
We will provide reasonable advance written notice where a proposed change materially affects Members' rights, obligations or core membership benefits.
17.3
Material changes will not be imposed during a fixed commitment period where doing so would unfairly disadvantage the Member or breach applicable law.
17.4
Where a proposed material change adversely affects the agreed membership and is not otherwise permitted by law, we will seek the Member's agreement or offer an appropriate cancellation option or remedy.
17.5
Continued use of the membership will not be treated as consent to a change where express agreement is required by law.
18

Liability and business outcomes

18.1
Forward Moves supplies educational and business support resources intended to assist with professional development and business activities.
18.2
We do not promise specific financial, revenue, client acquisition or commercial outcomes unless expressly stated in writing as part of the agreed services.
18.3
Members acknowledge that business outcomes can be influenced by factors outside Forward Moves' control.
18.4
Each party remains responsible for its own conduct and obligations under the agreement and applicable law.
18.5
To the extent permitted by law, neither party is responsible for losses caused solely by the other party's independent unlawful conduct or unauthorised actions.
